Terms of Service

These Terms of Service (“Terms”) govern your use of ViewsFeed (the “Service”), a concierge newsletter service that helps you produce and send email newsletters to your audience. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The service
ViewsFeed helps you plan, draft, refine, and send newsletters. Drafts are produced with the assistance of AI and a human concierge, based on information you provide (such as an intake, interview, uploaded files, and your feedback). You review and approve content; nothing is sent to your subscribers without your approval, except where you explicitly enable an automatic-send option, which always gives you advance notice and the ability to pause or cancel.
2. Your account
You must provide accurate information and keep your login credentials secure. You are responsible for activity under your account. You must be at least 18 years old and able to form a binding contract.
3. Your content and your audience
You retain ownership of the content you provide and of the newsletter content we produce for you, and you own your subscriber list. You grant ViewsFeed a limited license to use that content and data solely to provide the Service to you. You are solely responsible for: (a) having the necessary rights and permission to contact every person on your subscriber list; (b) obtaining all required consents; and (c) complying with all applicable laws governing email and marketing, including the CAN-SPAM Act and similar laws. Every issue we send on your behalf includes an unsubscribe mechanism and your physical mailing address, which you agree to keep current.
4. Acceptable use
You agree not to use the Service to send spam or unsolicited email, or to distribute unlawful, infringing, deceptive, harassing, or harmful content. We may suspend or terminate accounts that violate these Terms or that put sender reputation, recipients, or the Service at risk.
5. Fees and payment
The Service is offered on a per-issue basis. Pricing is agreed with you before work begins and invoiced for issues produced and sent. Fees are due as stated on your invoice. Unless required by law or stated otherwise in writing, fees for issues already sent are non-refundable. We may change pricing on a going-forward basis with notice.
6. AI-assisted content
Drafts are generated with the help of AI and may contain errors, inaccuracies, or material that needs editing. You are responsible for reviewing and approving every issue before it is sent. ViewsFeed is not responsible for content you approve.
7. Third-party services
The Service relies on third-party providers for hosting, data storage, AI/language processing, email delivery, and scheduling. Your use of the Service is also subject to those providers’ terms. We are not responsible for outages or actions of third-party providers outside our control.
8. Intellectual property
ViewsFeed, including its software, design, and brand, is owned by us. We grant you a limited, non-exclusive, non-transferable right to use the Service while these Terms are in effect.
9. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that emails will reach every recipient’s inbox.
10. Limitation of liability
To the maximum extent permitted by law, ViewsFeed will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the three months before the event giving rise to the claim.
11. Termination
You may stop using the Service at any time. We may suspend or terminate the Service or your account for violation of these Terms or as needed to protect the Service. You may request export or deletion of your data as described in our Privacy Policy.
12. Changes to these terms
We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above; continued use after changes means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of the State of Illinois, United States, without regard to its conflict-of-law rules.
